Q.: Will Gemini Personnel re-contact executives previously placed in my company?

A: Gemini Personnel has a strict Code of Practice and will under no circumstances solicit a candidate whom we have placed with a client.




Q.: Will Gemini Personnel provide legal advice for foreign companies not yet established in Thailand?


A: With the 1997 economic crisis behind us, the focus today is very much again on re-entering the Thai market, which holds tremendous potential for a variety of industries.

The first priority is establishing an office, and for those companies contemplating commencing business we are able to recommend a number of reputable legal firms.

Gemini Personnel can be of great assistance in recruiting key personnel to head up your Thai office. Recruiting the right staff can be a difficult process, and Gemini can help ensure that your Thailand operations are run to your expectations.

If a key appointment is made prior to the opening of a formally established office, Gemini Personnel can assist with provision of interview rooms on its premises. Gemini Personnel will further assist in giving free advice on Thai employment legislation and current salary levels for whatever positions you require, and generally help better acquaint you with the Thailand market.

Q.: Will Gemini Personnel make sure my company information is kept confidential?

A: Confidentiality of client and candidate information is paramount. Gemini Personnel maintains the strictest confidence of all sensitive matters concerning your business and operations, and shall not disclose them to anyone unless otherwise instructed.

Candidate Information: We expect our clients to maintain the strictest confidence of all information regarding candidates, and to use this information only for the purpose of evaluating and hiring these candidates.

Q.: What are the general terms and conditions for services rendered by Gemini Personnel?

A: Gemini will charge fees to clients in respect of a candidate who enters into a contract of employment, or a contract for services as a result of an introduction made by Gemini. An introduction will be deemed to have occurred once the client and candidate make contact by any means as a result of Gemini's efforts and search procedures. Fees will be charged if a candidate introduced by Gemini to the client is engaged within twelve months of the date of initial introduction.

  Fees are expressed and calculated as a percentage of the first year's total annual remuneration package. The annual remuneration package will include the basic salary and all other benefits reasonably estimated to be paid as cash (including guaranteed bonus, commissions, annual value of stock options, housing allowance and all other allowances).

  Based on the above information, Gemini Personnel will submit a fee proposal per assignment to the customer.

For Retained Executive Search & Selection Assignments , the client agrees to pay:

(1) A Commencement Fee (one third of the quoted fee) due immediately upon commencement of the assignment and not refundable under any circumstance;

(2) Short-list Fee (one third of the quoted fee), non refundable, payable upon interviewing of a short-list of candidates who in the opinion of Gemini meet the agreed job specification;

(3) A Completion Fee (one third of the quoted fee) payable on the day a candidate commences employment;



For Retained Advertised Search & Selection Assignments and Database Searches , the client agrees to pay a Completion Fee on the day a candidate commences employment.

All related advertising costs and/or possible administration costs will be previously agreed in writing between the client and Gemini Personnel. The client agrees to pay for advertising in advance.

Fees will be billed in Thai Baht

Replacement Guarantee:
In the event a candidate, which was referred by Gemini Personnel in the context of a retained search, is hired by you and subsequently terminated by you on reasonable, performance related grounds or the candidate chooses to resign his/her position within the agreed guarantee period, Gemini will provide one complimentary replacement based on the original job specifications. All requests for replacement must be made in writing within seven calendar days of the original candidate's termination or resignation. This replacement guarantee only applies if you have settled the debit note in full for the specific job as agreed.

Credit Note: If no suitable replacement candidate can be found within a three month period Gemini will provide clients (who have paid their fee in full within 30 days) a pro-rated credit note (up to maximum 50% of invoice amount) to be used against any future assignments
